Selling your property (assignment of lease)

As a leaseholder you have the right to sell your property.

Property purchased after 18 January 2005

If you applied to buy your property under the 'Right to Buy' after 18 January 2005, the council has the right to 'buy back' your property.

You will need to contact the home ownership team to find out if the council wishes to exercise this right.

Requesting information

If you want to sell your property, the council will on written request, provide you or your solicitor with any relevant factual information.

To obtain a pre-assignment pack you (or your solicitor) should submit a request in writing (we accept requests by email) to the Leasehold & Procurement Services.  To help us identify you as the leaseholder concerned, please provide:

  • Your full name
  • The full address of the leasehold property concerned
  • Your address (if different)
  • Your service charge account reference number

Please note that a written request must be made before we can accept payment for the pre-assignment pack. The fee can be paid either by cheque or by debit or credit card by telephoning 020 8871 8464. The Pre-Assignment Pack fee is currently £262.50 (inclusive of VAT).

On receipt of the fee, which is non-refundable, the information requested will be collated and sent by email. This process usually takes three weeks from date of payment.

Financial matters - selling your property

Service charges and loans

When your lease is assigned (sold), all service charge arrears, including deferred loans, must be cleared on completion of sale.

The council will not be party to the apportionment of outstanding service charges between leaseholders and purchasers. It is your responsibility to ensure that your solicitor resolves this and having done so, retains sufficient monies for charges not yet billed.

Please note: It is the Purchaser's duty to give formal notice to the Council’s Solicitor within one month of any assignment. The registration fee is £30 per Notice unless otherwise stated in the Lease. (VAT is not chargeable).
